1. ACCEPTANCE
1.1 The following terms and conditions apply to all bookings made with Go New Zealand Tours Limited (“the Company”). The Company will rely on the authority of the party making the booking (“the Customer”) to act on behalf of any other party involved and the Customer will bind all involved parties to these terms and conditions.
2. AGENCY
2.1 The Company act as agent for, and sell various travel related products on behalf of, transport operators, accommodation providers, tour operators and other service providers
2.2 The Customer expressly authorise the Company to make bookings on their behalf and to arrange relevant contracts between the Customer and the service providers.
2.3 All travel bookings are subject to the terms and conditions of the relevant service provider, including any health and safety policy. The Company will provide copies of the relevant terms and conditions on request.
2.4 The Company will exercise care in the selection of reputable service providers, but the Company is not a travel service provider and cannot guarantee the performance of the functions of the service providers.
2.5 The Company will not be liable if the Customer suffers loss, injury or disappointment by reason of any acts or failings of any service provider.
3. PRICE
3.1 Prices will be quoted in United States Dollar, unless specifically stated otherwise and are subject to change. Changes may result from matters outside of the Company’s control including adverse currency fluctuations and airfare increases.
4. PAYMENT
4.1 The Customer may be required to pay a deposit to confirm a booking. The Company will advise if this is required, the amount payable and when payment is due. All deposits are non-refundable for Customer cancellations.
4.2 The Customer must pay the balance of the Price at least 8 weeks prior to the departure date.
4.3 Payment may be made by electronic bank transfer, credit card or debit card, surcharges may apply.
5. TRAVEL INSURANCE
5.1 The Company strongly recommends that the Customer take out appropriate travel insurance to cover travel arrangements. Insurance should be adequate to meet the Customers requirements including cover for medical expenses from sickness or injury, loss or damage of personal belongings, and high-risk activities.
6. TRAVEL DOCUMENTS/PASSPORTS
6.1 The Company does not provide health, insurance, visa or immigration advice and will proceed on the basis that the Customer making a booking have valid passports, visas and re-entry visas as required, unless advised otherwise.
6.2 Service providers may require the Customer to have specific vaccinations, and pass other medical requirements. The Customer is responsible for ensuring any and all requirements are met. The Company are not liable in the event the Customer fails to meet the medical or health requirements in relation to their booking.
7. LIMITATION OF LIABILITY
7.1 To the extent permitted by law, the Company does not accept any liability for any loss (including consequential loss) or damage, injury, delay, inconvenience, loss of enjoyment or expenses caused directly or indirectly, by acts, omissions or default, whether by negligence or otherwise, of third parties, or where not preventable by the Company’s reasonable diligence. Where the Company’s liability cannot be excluded and where the Company’s liability may be lawfully limited, then that liability will be limited to the remedies provided by law.
8. GENERAL
8.1 Any dispute will be subject to the law of New Zealand and the jurisdiction of the New Zealand Courts.
8.2 The Company may amend or vary these terms and conditions at any time. The applicable terms and conditions are those in effect at the time of booking.
8.3 The Customer understands that any information they give to the Company will be held by the Company and used by the Company in fulfilling its obligations in respect of the booking. The Customer may ask for access to any information provided, and request a correction of any of the personal or private information held by the Company.
